Terms and Conditions

Please read these Terms and Conditions (“Terms”) carefully. They form a binding agreement between you and Med Spa (“Med Spa,” “we,” “us,” or “our”), governing your use of medspa-deals.com, our mobile and web applications, and all related services (together, the “Platform”).

By creating an account, completing an assessment, or placing an order, you agree to these Terms. If you do not agree, do not use the Platform.

These Terms contain an arbitration agreement and a class action waiver in Section 17. Please read that section carefully, as it affects how disputes between us are resolved.

 

1. Important Medical Disclaimer

The Platform is not a substitute for emergency care. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately. Do not use the Platform to communicate an urgent medical concern.

If you are having thoughts of harming yourself, call or text 988 (Suicide & Crisis Lifeline) in the United States.

Content on the Platform — including quiz results, articles, product descriptions, and general wellness information — is provided for informational purposes only and does not constitute medical advice. Only a licensed clinician who has evaluated your individual medical history can advise you on treatment.

2. Eligibility

To use the Platform, you must:

  • Be at least 18 years of age
  • Be physically located in a US state or the District of Columbia where we are licensed to operate at the time of your consultation
  • Have the legal capacity to enter into a binding contract
  • Provide accurate, complete, and current information about yourself

We do not knowingly collect information from or provide services to minors. Certain treatments carry additional eligibility restrictions, and some are not available in all states.

3. The Nature of Our Services

We are a technology and administrative platform. Med Spa is not a medical practice, a pharmacy, or an insurer, and does not practice medicine or dispense medication.

  • Medical services are provided by independent, licensed healthcare providers who are solely responsible for their own clinical judgment. These providers are affiliated with [PROFESSIONAL ENTITY NAME(S)], not employed by us to render clinical care.
  • Pharmacy services are provided by independent licensed pharmacies, including compounding pharmacies where applicable.
  • We provide the software, scheduling, billing, logistics, and customer support that connect these parties.

Your clinician–patient relationship is with your provider, not with us.

4. No Guarantee of Prescription or Outcome

Submitting an assessment, paying a consultation fee, or requesting a specific product does not entitle you to a prescription.

A licensed provider will review your information and may decline to prescribe if treatment is not clinically appropriate, if more information is needed, or if you do not meet eligibility criteria. This is a feature of responsible medical care, not a service failure.

We make no representation, warranty, or guarantee regarding treatment outcomes. Individual results vary based on physiology, adherence, and factors outside anyone’s control. Any testimonials, before-and-after images, or statistics shown on the Platform reflect individual experiences and are not a promise of similar results for you.

5. Your Responsibilities as a Patient

You agree to:

  • Provide accurate and complete medical history, including all current medications, supplements, allergies, and conditions
  • Promptly update your provider if your health status changes
  • Use medications only as prescribed, and never share them with another person
  • Attend required follow-ups and lab work when requested
  • Maintain a relationship with a primary care provider
  • Report side effects or adverse reactions promptly to your provider and, where appropriate, to the FDA MedWatch program

Providing false or incomplete health information may result in a treatment plan that is unsafe for you. You accept responsibility for the accuracy of what you submit.

6. Telehealth Consent

By using the Platform, you consent to receive care via telehealth (asynchronous messaging, video, or phone). You understand that:

  • Telehealth has limitations compared with in-person care, including the absence of a physical examination
  • Technology failures could delay or interrupt care
  • Your provider may determine that in-person evaluation is necessary and decline to treat you remotely
  • You may withdraw this consent at any time, though doing so may end your ability to receive services through the Platform

A separate, more detailed Informed Consent to Telehealth may be presented to you before your first consultation. Where that document conflicts with these Terms on clinical matters, that document controls.

7. Compounded Medications

Some products offered through the Platform are compounded — prepared by a licensed compounding pharmacy for an individual patient based on a prescription.

Compounded medications are not FDA-approved and are not reviewed by the FDA for safety, effectiveness, or manufacturing quality in the way commercially manufactured drugs are. They are permitted under Sections 503A and 503B of the Federal Food, Drug, and Cosmetic Act. Your provider will discuss whether a compounded formulation is appropriate for you and what that means.

8. Accounts and Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@medspa-deals.com if you suspect unauthorized access. Do not share your account with anyone else, including family members.

We may suspend or terminate an account that we reasonably believe has been used to provide false medical information, to obtain medication for someone else, to divert or resell medication, or in violation of these Terms.

9. Orders, Pricing, and Payment

  • All prices are listed in US Dollars (USD) and are exclusive of taxes and shipping unless stated otherwise.
  • We reserve the right to correct pricing errors, and to cancel and refund any order affected by an obvious error.
  • By providing a payment method, you authorize us and our payment processors to charge it for all fees you incur.
  • We are not an insurance provider and do not bill insurance. Services are self-pay. You may be able to use HSA/FSA funds — check with your plan administrator.
  • Payment is processed by third-party providers. We do not store full card numbers on our systems.

10. Subscriptions and Automatic Renewal

Some plans renew automatically until cancelled.

By enrolling in a subscription, you authorize recurring charges to your payment method at the stated interval and amount until you cancel.

  • We will disclose the renewal frequency, amount, and cancellation method before you enroll, and will send renewal reminders where required by law.
  • You may cancel at any time through your account dashboard or by emailing support@medspa-deals.com.
  • Cancellation takes effect for the next unprocessed billing cycle. See our Refund Policy for details on timing and refund eligibility.
  • Prices may change on renewal. We will give you at least 30 days’ advance notice before any price increase takes effect, and you may cancel before it does.

11. Shipping

We ship to addresses within the United States, excluding US territories unless otherwise stated at checkout. We do not ship internationally. We do not ship to P.O. boxes for temperature-sensitive or controlled products. Title and risk of loss pass to you on delivery to the address you provide.

Delivery estimates are estimates only. Prescription orders require provider approval and pharmacy processing before shipment, which adds time to the total timeline.

You are responsible for providing an accurate shipping address and for ensuring someone can receive temperature-sensitive shipments promptly.

12. Refunds and Cancellations

Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference. In summary: dispensed prescription medications cannot be returned or refunded, and consultation fees are non-refundable once a provider has reviewed your submission.

13. Privacy and Health Information

Your use of the Platform is also governed by our Privacy Policy and, where applicable, our Notice of Privacy Practices describing how protected health information is handled under HIPAA.

By using the Platform, you consent to the collection and use of your information as described in those documents.

14. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose, or to obtain medication by deception
  • Impersonate another person or create an account on someone else’s behalf without authorization
  • Resell, distribute, or divert any product obtained through the Platform
  • Attempt to access another user’s account or health information
  • Scrape, crawl, reverse-engineer, or interfere with the Platform or its security features
  • Upload malicious code, or content that is defamatory, harassing, or infringing
  • Use automated systems to place orders or create accounts

15. Intellectual Property

All content on the Platform — text, graphics, logos, images, software, and the arrangement of them — is owned by Med Spa or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access the Platform for personal, non-commercial use. All other rights are reserved.

You may not use our name, logos, or branding without prior written permission.

16. Disclaimers and Limitation of Liability

Disclaimer. Except as expressly stated and except for warranties that cannot be excluded by law, the Platform is provided “as is” and “as available.” We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure.

Limitation. To the fullest extent permitted by law, Med Spa and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Platform.

Cap. Our total aggregate liability for any claim relating to the Platform will not exceed the greater of US $500 or the total amount you paid us in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded. These limitations do not apply to the professional medical services rendered by your independent provider, whose liability is governed by applicable medical malpractice law.

17. Dispute Resolution and Arbitration

Please read this section carefully — it affects your legal rights.

Informal resolution first. Before filing any claim, you agree to contact us at legal@medspa-deals.com and attempt to resolve the dispute informally for at least 60 days.

Binding arbitration. If we cannot resolve the dispute informally, you and we agree that any dispute arising out of or relating to these Terms or the Platform will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration will take place in [CITY, STATE — your principal place of business], in the federal judicial district where you reside, or by videoconference, at your election.

Class action waiver. You and we agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding.

Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court for intellectual property infringement or unauthorized access.

Opt-out. You may opt out of this arbitration agreement by emailing legal@medspa-deals.com within 30 days of first accepting these Terms, stating your name and intent to opt out. Opting out does not affect any other part of these Terms.

This section does not apply to medical malpractice claims, which are governed by the law of the jurisdiction in which care was rendered.

18. Indemnification

You agree to indemnify and hold harmless Med Spa and its affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, your provision of false health information, or your violation of any law or third-party right.

19. Governing Law

These Terms and any dispute arising from them are governed by the laws of the United States and the State of [YOUR STATE — see note below], without regard to conflict of laws rules. Subject to Section 17, the state and federal courts located in [YOUR COUNTY AND STATE] will have exclusive jurisdiction.

The Federal Arbitration Act governs the interpretation and enforcement of Section 17.

Nothing in this section deprives you of the protection of any mandatory consumer protection law of the state in which you reside.

Note to Med Spa: “USA” cannot be entered here on its own. The United States has no single body of contract or consumer law — governing law clauses must name a specific state. Use the state where your business is incorporated or has its principal place of business (commonly Delaware for the entity, or your operating state). Your attorney will confirm which is correct for your structure.

20. Third-Party Links and Services

The Platform may link to third-party websites or integrate third-party services. We do not control and are not responsible for their content, practices, or policies. Your dealings with third parties are solely between you and them.

21. Termination

You may close your account at any time by contacting support@medspa-deals.com. We may suspend or terminate your access at any time, with or without notice, for breach of these Terms or where continued service would be unlawful or unsafe.

On termination, provisions that by their nature should survive — including Sections 12, 15, 16, 17, 18, and 19 — will remain in effect. We will retain your medical records as required by applicable law.

22. Changes to These Terms

We may modify these Terms at any time. Material changes will be posted here with an updated “Last updated” date and, where required, communicated to you directly. Your continued use of the Platform after changes take effect constitutes acceptance. If you do not agree, stop using the Platform and close your account.

23. General

  • Entire agreement. These Terms, together with the Refund Policy, Privacy Policy, and any consent forms, constitute the entire agreement between you and us.
  • If any provision is held unenforceable, the remainder stays in force.
  • No waiver. Our failure to enforce a provision is not a waiver of it.
  • You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
